For the avoidance of doubt, Eldorado’s obligations under this Article 4 pertaining to requests for Initial Diligence Materials and Additional Diligence Materials relate solely to obtaining existing materials and information and in no event shall Eldorado be required to commission or create, or cause to be commissioned or created, any new studies, surveys, inspections or other diligence materials.
Any such Person not responding within 10 Business Days after receipt of such Additional Diligence shall be deemed to have declined to consent to an increase in such Lender’s Commitment.
In the event the Condominium Diligence Deposit is insufficient to pay the Condominium Diligence Fees in full, Purchaser and Seller shall each deposit an additional $50,000.00 (the "Additional Diligence Deposit") with Escrow Agent within five (5) days after receipt of a notice from Escrow Agent of such insufficiency.
In the event there are any funds remaining from the Condominium Diligence Deposit and/or the Additional Diligence Deposit after payment in full of the Condominium Diligence Fees, such remainder shall be paid by Escrow Agent one-half to Purchaser and one-half to Seller.

If Buyer is not satisfied with the Property for any reason or no reason, in Buyer's sole discretion, then Buyer may terminate this Agreement by written notice to Seller on or before the end of the Additional Diligence Period, provided, however, that if Buyer elects to terminate during the Additional Diligence Period, Buyer shall not receive the return of the Deposit, the Deposit shall be delivered to Seller, and the parties shall be released from all further obligations hereunder.
