At the Origin, Seller shall be allowed the first four (4) hours to load all Coal Cars in the Unit Train after Actual Placement or Constructive Placement by the Railroad at no cost or charge to Seller ("Loading Free Time").
When a Unit Train arrives at or attempts to arrive at Origin or Destination and another Unit Train (or Unit Trains) occupies the Origin or Destination which prevents the Actual Placement for loading or unloading of the Unit Train for a period of one hour or more, not due to any cause attributable to BNSF (the "Bunched Unit Train").
Each such assignment shall be evidenced by an assignment substantially in the form of an Assignment and Assumption Agreement or other form reasonably acceptable to Agent Bank and Borrower.
