Access to PHI definition

Access to PHI. Upon the request by Contracting Entity, Business Associate shall promptly provide PHI to Contracting Entity to permit any individual whose PHI is maintained by Business Associate to have access to and to copy his/her PHI in accordance with 45 C.F.R. §164.524, the HITECH Act and applicable Pennsylvania law. Such PHI shall be produced in the format requested by Contracting Entity, unless it is not readily producible in such format, in which case it shall be produced in hard copy format. If Business Associate maintains and Electronic Health Record, Business Associate shall provide such information in electronic format to enable Contracting Entity to fulfill its obligations under the HITECH Act. If an individual contacts Business Associate directly for such access, Business Associate shall direct the individual to contact the Contracting Entity. This requirement to provide access to the PHI shall only apply if the PHI in Business Associate’s possession is part of the Contracting Entity’s Designated Record Set.

Examples of Access to PHI in a sentence

  • Within five (5) business days, Business Associate shall forward to Covered Entity for handling any request for Access to PHI that Business Associate directly receives from an Individual.

  • Within five (5) business days, Contractor Business Associate shall forward to Covered Entity for handling any request for Access to PHI that Contractor Business Associate directly receives from an Individual.

  • Business Associate shall notify Covered Entity within five (5) Days of receipt of a request for Access to PHI.

  • Insurer warrants that all Persons will have passed the background screening described herein before they have Access to PHI, PII, or financial information, and all Persons will undergo a background screening every five (5) years thereafter.

  • Business Associate shall notify Covered Entity within five (5) days of receipt of a request for Access to PHI.

  • Provider represents and warrants to Tower that Provider shall strictly limit Provider’s and/or the Provider’s Authorized Users’ use and Access to PHI stored in the Platform to: (i) the minimum necessary to accomplish the intended purpose of the use, disclosure, or request with respect to a Patient, or (ii) treatment of a Patient.
