Accepted Industry Practices definition

Accepted Industry Practices means those practices, methods and acts generally employed or approved by a significant portion of the solar photovoltaic generation and energy storage industry in MISO South with respect to assets and properties of a type and size similar to those constituting the Facility during the relevant time period that, in the exercise of reasonable judgment in light of the facts known at the time a decision is made, would have been expected to accomplish the desired result consistent with good solar photovoltaic generation and energy storage industry practices, reliability, safety and the requirements of applicable Laws and permits. Accepted Industry Practices are not intended to be limited to the optimum practices, methods or acts to the exclusion of others, but rather are intended to include a spectrum of possible practices, methods and acts generally employed or approved by a significant portion of the solar photovoltaic generation and energy storage industry in MISO South during the relevant time period that meet the requirements of the preceding sentence.
Accepted Industry Practices means those practices, methods and acts generally employed or approved by a significant portion of the wind power generation and energy storage industry in the relevant region of the United States of America with respect to assets and properties of a type and size similar to those constituting the Facility during the relevant time period that, in the exercise of reasonable judgment in light of the facts known at the time a decision is made, would have been expected to accomplish the desired result consistent with good wind power generation and energy storage industry practices, reliability, safety and the requirements of applicable Laws and permits. Accepted Industry Practices are not intended to be limited to the optimum practices, methods or acts to the exclusion of others, but rather are intended to include a spectrum of possible practices, methods and acts generally employed or approved by a significant portion of the wind power generation and energy storage industry in the relevant region of the United States of America during the relevant time period that meet the requirements of the preceding sentence.
Accepted Industry Practices means those practices, methods and acts generally employed or approved by a significant portion of the solar photovoltaic generation industry in the relevant region of the United States of America during the relevant time period that, in the exercise of reasonable judgment in light of the facts known at the time a decision is made, would have been expected to accomplish the desired result consistent with good solar photovoltaic generation industry practices, reliability, safety and the requirements of applicable Laws. Accepted Industry Practices are not intended to be limited to the optimum practices, methods or acts to the exclusion of others, but rather are intended to include a spectrum of possible practices, methods and acts generally employed or approved by a significant portion of the solar photovoltaic generation industry in the relevant region of the United States of America during the relevant time period that meet the requirements of the preceding sentence.

Examples of Accepted Industry Practices in a sentence

  • Notwithstanding the foregoing, if the equipment, technology or any other aspect contemplated by this Section 8.4(c) becomes antiquated, obsolete, impracticable or outside of Accepted Industry Practices and Buyer so requests, Seller shall modify such aspects as reasonably requested by Buyer to bring them back into then-current equipment and technology, practicability and Accepted Industry Practices.

  • Without limiting the generality of the foregoing, each Capacity Demonstration Test and Storage Capacity Demonstration Test shall account for energy losses to the Electric Interconnection Point in accordance with Accepted Industry Practices.

  • Seller shall require that the Person conducting each Capacity Demonstration Test or Storage Capacity Demonstration Test perform such test in accordance with Accepted Industry Practices, the protocols and the procedures set forth on Schedule 3.12 and any other applicable requirements of this Agreement.

Related to Accepted Industry Practices

  • Good Industry Practices means the practices that would be adopted by, and the exercise of that degree of care, skill, diligence, prudence and foresight that reasonably would be expected from, a competent contractor in the international oil and gas industry experienced in performing work similar in nature, size, scope and complexity to the Work and under conditions comparable to those applicable to the Work, where such work is subject to, and such contractor is seeking to comply with, the standards and codes specified in the Contract or (to the extent that they are not so specified) such national or international standards and codes as are most applicable in the circumstances, and the applicable Law.

  • Good Industry Practice means standards, practices, methods and procedures conforming to the Law and the exercise of the degree of skill and care, diligence, prudence and foresight which would reasonably and ordinarily be expected from a skilled and experienced person or body engaged within the relevant industry or business sector;

  • Prudent Industry Practices means, at a particular time, any of the practices, methods, standards of care, skill, safety and diligence, as the same may change from time to time, but applied in light of the facts known at the time, that are consistent with the general standards applied or utilized under comparable circumstances by a reasonably prudent operator, in a good and workmanlike manner, with due diligence and dispatch, in accordance with good midstream industry practice.

  • Best Industry Practice means that degree of skill, care and foresight and operating practice that would reasonably and ordinarily be expected of a skilled and competent supplier of services engaged in the same type of undertaking as that of the Recipient or any contractors (as applicable) under the same or similar circumstances as those contemplated by this Agreement.

  • Prudent Industry Practice means such practices, methods, acts, techniques, and standards as are in effect at the time in question that are consistent with the higher of (a) the standards generally followed by the United States pipeline and terminalling industries and (b) the standards applied or followed by Delek US or its Affiliates in the performance of similar tasks or projects, or by the Partnership Group or its Affiliates in the performance of similar tasks or projects.
