ACA Account definition

ACA Account means one or more of the Borrower’s securities accounts and/or deposit accounts maintained with NYDIG, an Affiliate thereof, Coinbase Custody Trust Company, LLC, a New York limited purpose trust company (“Coinbase”), or with such other securities intermediary or financial institution as agreed in advance by the Collateral Agent and the Borrower and designated pursuant to an applicable Loan Schedule (or otherwise as agreed in writing between the Borrower and the Collateral Agent) as an “ACA Account”.
ACA Account means, with respect to each Borrower, one or both of (i) such Borrower’s Reserve Account, or (ii) such Borrower’s deposit account(s) maintained with NYDIG or an Affiliate thereof, or with such other financial institution as agreed in advance by the Lender and such Borrower (each such institution, an “Account Bank”), and designated pursuant to the applicable Loan Schedule (or otherwise as agreed in writing between such Borrower and the Lender) as the “ACA Account”.
ACA Account means one or more of (i) any Reserve Account, or (ii) any of any Borrower’s deposit accounts maintained with NYDIG or an Affiliate thereof and designated pursuant to an applicable Loan Schedule (or otherwise as agreed in writing between the Borrowers and the Lender) as an “ACA Account”.

Examples of ACA Account in a sentence

  • See Section 11(a) below for the procedures for closing your ACA Account.

  • Please contact your Plan Administrator for information about any additional fees that may be assessed to your ACA Account.

  • If your Plan's Guidelines require the fee to be assessed to your ACA Account, the Annual Fee will be due in full by the Payment Due Date for the billing cycle in which the Annual Fee was incurred, which is the anniversary date of your ACA Account being established.

  • If applicable, the amount of your Plan's Annual Fee will be disclosed to you at the time you apply for your ACA Account.

  • The terms of default under your Plan may be different than the events constituting default on your ACA Account under this Agreement and may result in negative tax consequences and premature distribution penalties.

  • A portion of the Annual Fee may be paid to ACA for services related to the above annual maintenance of your ACA Account.

  • Any Annual Fee will either be assessed directly to your Plan Account or it will be assessed to your ACA Account according to your Plan's Guidelines.

  • Your obligation to pay any unpaid balance on your ACA Account and corresponding finance charges and other charges or fees, as determined under this Agreement, shall continue if your ACA Account is cancelled.

  • The Annual Fee will be paid to the Plan Administrator for services related to the annual maintenance of your ACA Account within their recordkeeping system, including annual reporting, balancing loan positions within your ACA Account, and processing trades to transfer money between your ACA Account and Plan Account.

  • ACA may pay a portion of the Service Charge to your Plan's recordkeeper for recordkeeping services provided in connection with your ACA Account.
