The bonds shall be furnished on Owner’s forms and shall be executed by a surety company authorized to do business in the State of Arizona and shall strictly comply with ABOR Policy 3-804 E, which policy shall control in the event of any conflict of the Bonds, or either of them with the requirements of these General Conditions.
In accordance with ABOR Section 3-804B.3.a, the University of Arizona intends to enter into a contract for services by a qualified Design Professional (“DP”) for the services as set forth in the Project Authorization(s).
The University may cancel this Agreement if any person significantly involved in negotiating, drafting, securing or obtaining this Agreement for or on behalf of the ABOR becomes an employee in any capacity of any other party or a consultant to any other party with reference to the subject matter of this Agreement while the Agreement or any extension thereof is in effect.
The Contractor’s selection of any Subcontractor must comply with ABOR Policy 3-804B(3)(h)((1)) and ((2)) and must be based on qualifications alone, or on a combination of qualifications and price selection, but shall not be based on price alone.
If the Legislature fails to appropriate the necessary funds, or if the University’s appropriation is reduced during the fiscal year, ABOR may reduce the scope of this Agreement if appropriate or cancel this Agreement without further duty or obligation.
ABOR in no way warrants that the minimum limits contained herein are sufficient to protect the Company from liabilities that might arise out of the performance of the services under this Agreement by the Company, its agents, representatives, employees or subcontractors, and Company is free to purchase additional insurance.
With the exception of (10) day notice of cancellation for non-payment of premium, any changes material to compliance with this agreement in the insurance policies above shall require (30) days written notice to ABOR.
Claims involving defective design or construction work discovered after Final Completion shall be resolved in accordance with this Section, as applicable, and ABOR Policy 3-809.
If the Legislature fails to appropriate the necessary funds, or if UNIVERSITY's appropriation is reduced during the fiscal year, ABOR may reduce the scope of this Agreement if appropriate or cancel this Agreement without further duty or obligation.
University agrees to notify Company as soon as reasonably possible after ABOR knows of the loss of funds.
