a Editorial note. This section reproduces the text of the GATT 1947, annexed to the Final Act Adopted at the Conclusion of the Second Session of the Preparatory Committee of the United Nations Conference on Trade and Employment (excluding the Protocol of Provisional Application), as rectified, amended or modified by the terms of legal instruments which have entered into force before the date of entry into force of the WTO Agreement. The GATT 1994 and the GATT 1947 are legally distinct, and the legal instruments through which GATT contracting parties had been applying the GATT 1947 were terminated one year after the date of entry into force of the WTO Agreement. See Article II:4 of the WTO Agreement and GATT documents PC/ 12 and L/7583. Pursuant to paragraph 1(a) of the GATT 1994, the GATT 1947 is part of the GATT 1994. As provided in paragraph 2(a) of the GATT 1994, certain terms in the GATT 1947 should be read as referred to in the WTO Agreement and its Annexes. In particular, "contracting party" shall be deemed to read "Member"; "less-developed contracting party" and "developed contracting party" shall be deemed to read "developing country Member" and "developed country Member"; and "Executive Secretary" shall be deemed to read "Director-General of the WTO". Moreover, the references in certain provisions to CON- TRACTING PARTIES shall be deemed to be references to the WTO, while the other functions assigned to the CONTRACTING PARTIES acting jointly shall be allocated by the Ministerial Conference. For the convenience of the reader, asterisks mark the portions of the text which should be read in conjunction with notes and supplementary provisions in Annex I.
