The products covered by this Settlement Agreement are PVC stretch tie tape including, but not limited to, the Garden Ease PVC Stretch Tie Tape; UPC: 8 18068 09124 9, manufactured, sold, or distributed for sale in California by 99 Cents Only (hereinafter the “Products”).

Shortly after the other settlement terms had been reached, 99 Cents Only expressed a desire to resolve the attorneys’ fees and costs.
Under this provision and general contract principles, 99 Cents agrees to pay $18,000 to ▇▇▇▇▇▇▇ and his counsel for all fees and costs incurred investigating, bringing this matter to the attention of 99 Cents’ management, and negotiating a settlement in the public interest.
This Settlement Agreement is entered into by and between ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇ (“▇▇▇▇▇▇▇▇▇”) and 99 Cents Only Stores LLC (“99 Cents Only”).
This Agreement shall not be construed as an admission of liability by 99 Cents but to the contrary as a compromise of claims that are expressly contested and denied.
The purchase price of the Option Shares shall be 99 Cents ($0.99) per share, which shall be the closing price on the date of grant.
