33rd Hour definition
33rd Hour means the On-Peak Hour during the Capacity Commitment Period with the 33rd lowest amount of Delivered Energy that the Buyer is obligated under this EPA to accept when compared to the amount of Delivered Energy that the Buyer is obligated to accept in all other On-Peak Hours of the Capacity Commitment Period, provided that any On-Peak Hour during a Capacity Commitment Period in which the Seller is unable to deliver Energy to the POI as a result of Force Majeure invoked by the Seller under section 14.8 or 14.9 will not be considered in determining the 33rd Hour; and
