SEVERABILITY CLAUSE. 9.01 Should any provision of the Agreement and/or GTC is found to be invalid or ineffective by operation of law, this will not affect the validity or effectiveness of other provisions unless it clearly follows from the circumstances that Agreement would not have been concluded without the provisions directly affected by the invalidity or ineffectiveness.
9.02 In the case referred to in point 9.01 of this paragraph, the parties will conclude an annex to the Agreement where they will formulate such replacement provisions whose economic purpose will be equivalent or similar to that of the invalid or ineffective provisions. Should it clearly follows from the circumstances that without the invalid or ineffective provisions the Agreement would not have been concluded, the parties will immediately start negotiations in order to conclude a new contract whose economic purpose will be equivalent or similar to that of the Agreement.
9.03 Until the negotiations referred to in the preceding sentence are completed, the parties will fulfill their obligations provided for in the Agreement to the extent it is not contrary to mandatory law provisions and the legitimate interest of both parties.
SEVERABILITY CLAUSE. Applicable law and place of jurisdiction
SEVERABILITY CLAUSE. If any provision of this contract is or will become invalid or unenforceable, it shall not affect other provisions of this contract, which shall remain valid and effective. The contracting parties undertake in this case to agree to replace the invalid and ineffective provision by a new valid and effective provision, which corresponds best with the originally intended purpose of the invalid and ineffective provision. Until then, the generally binding legislation of the Czech Republic shall be applied.
SEVERABILITY CLAUSE. Should a provision of the Contract Modules (including fees) be declared invalid, the remaining provisions shall not be affected thereby and are to be construed in such a way as if the Contract Module concerned was concluded without the invalid provision. The same applies to any contrac- tual omissions.
