Common use of PERSONAL DATA Clause in Contracts

PERSONAL DATA. 14. OSOBNÍ ÚDAJE. 14.1. Hexagon reserves the right, but does not assume the obligation, to investigate any violation of this Exhibit D (Cloud Program 14.1. Hexagon may report any activity that Hexagon suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Hexagon’s reporting may include disclosing appropriate information related to Customer or any User. Hexagon also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Exhibit D (Cloud Program Conditions) and/or AUP. ZPP nebo zneužití Cloudových služeb či Cloudového programu. Společnost Hexagon může: (a) vyšetřit porušení této Přílohy D (Podmínky cloudového programu) anebo ZPP nebo zneužití Cloudových služeb či Cloudového programu; a (b) odstranit či upravit jakýkoliv obsah nebo zdroj, který porušuje tuto Přílohu D (Podmínky cloudového programu) anebo ZPP, nebo k takovému obsahu či zdroji znemožnit přístup. Společnost Hexagon je oprávněna oznámit jakoukoliv aktivitu, u níž má podezření, že porušuje jakýkoliv zákon či nařízení, příslušným představitelům donucovacích orgánů, regulátorům či jiným příslušným třetím osobám. V rámci tohoto oznámení může společnost Hexagon sdělit příslušné informace týkající se Zákazníka nebo jiného Uživatele. Společnost Hexagon může také spolupracovat s příslušnými donucovacími orgány, regulátory či jinými příslušnými třetími osobami v rámci součinnosti při vyšetřování a stíhání nezákonného jednání, a to tím, že poskytne síťové a systémové informace týkající se údajných porušení této Přílohy D (Podmínky cloudového programu) anebo ZPP. 14.2. Unless Customer Specified Data Center(s) are included in the Cloud Services as identified in the Quote, Hexagon and its Third Party Service Provider shall have sole discretion of the location of the Data Center(s). 14.2. Pokud není do Cloudových služeb uvedených v Cenové nabídce zahrnuto Zákazníkem specifikované datové centrum (centra), pak společnost Hexagon a jeho Třetí poskytovatel služeb mají výhradní právo rozhodnout o umístění Datového centra (center).

Společnost Hexagon je oprávněna oznámit jakoukoliv aktivitu, u níž má podezření, že porušuje jakýkoliv zákon či nařízení, příslušným představitelům donucovacích orgánů, regulátorům či jiným příslušným třetím osobám. V rámci tohoto oznámení může společnost Hexagon sdělit příslušné informace týkající se Zákazníka nebo jiného Uživatele. Společnost Hexagon může také spolupracovat s příslušnými donucovacími orgány, regulátory či jinými příslušnými třetími osobami v rámci součinnosti při vyšetřování a stíhání nezákonného jednání, a to tím, že poskytne síťové a systémové informace týkající se údajných porušení této Přílohy D (Podmínky cloudového programu) anebo ZPP. 14.2.
