THIS DEED OF TRUST, ASSIGNMENT OF RENTS, SECURITY AGREEMENT AND FIXTURE FILING (this “Mortgage”) is made as of this 3rd day of March, 2006, by MB SUGAR LAND GILLINGHAM LIMITED PARTNERSHIP, an Illinois limited partnership, having its principal place of business at 2901 Butterfield Road, Oak Brook, Illinois 60523, as mortgagor (“Borrower”), to WILLIAM D. CLEVELAND, having an address at 909 Fannin Street, Suite 200, Houston, Texas 77010, as trustee (“Trustee”), for the benefit of NOMURA CREDIT & CAPITAL, INC., a Delaware corporation, its successors and assigns, having an address at 2 World Financial Center, Bldg. B., New York, New York 10281, as beneficiary (“Lender”).
