This letter agreement and release (the “Agreement”) confirms the agreement entered into between you and the Company regarding your separation from your employment with the Company effective as of October 13, 2006 (the “Separation Date”) and explains the package of separation pay and benefits that has been specially developed for you in full bargained for release and settlement of any and all claims that you have presently, may have or have had in the past arising from your employment with and separation from your employment with the Company up to and including the Effective Date of this Agreement, including any claims in respect of the Employment Agreement between you and the Company dated as of August 18, 2003, as amended effective as of August 17, 2004 and March 2, 2006 (the “Employment Agreement”).
