This Fourth Forbearance and Amendment Agreement (this “Agreement”) is made and entered into July 9, 2010 and, upon satisfaction of the conditions precedents set forth in Paragraph 3 below, effective as of May 15, 2010 (the “Effective Date”), by and between JPMorgan Chase Bank, N.A. ( “Lender”), United Western Bancorp, Inc. ( “Borrower”), and Equi-Mor Holdings, Inc. ( “Pledgor”).
