This Amended and Restated Operating Agreement, hereinafter referred to as this “Agreement,” is dated as of February , 2016 and is by and among Kansas Educational Risk Management Pool, LLC, a Kansas limited liability company (the “Pool”), the Boards of Education, Governing Boards or Controlling Authorities of the school districts and state agencies listed on Appendix A, attached hereto, as the members of the Pool each of which may be referred to hereinafter as a “Member” and which, collectively, may be referred to hereinafter as the “Members,” and the Board (as defined herein).
