Plaintiffs Max Weiss, Lezley Holmes, Sebastien Tardiff, and John Maczynski (collectively, “Plaintiffs”) and Defendant SunPower Corporation (“SunPower”), stipulate and agree, pursuant to the terms of this Settlement Agreement (the “Settlement Agreement,” “Settlement,” or “Agreement”), to settle, resolve, and compromise the claims asserted by Plaintiffs, individually and acting as class representatives for the Settlement Class defined below, against SunPower in the above-captioned lawsuit. Plaintiffs and SunPower are referred to collectively as the “Parties” and each individually as a “Party.” This Agreement is made and entered into by the Parties as of June 30, 2021, and was modified by agreement of the Parties on October 21, 2021.
