The St. Andrews Club, Inc. (the “Club”), a corporation organized under the Florida Not-for-Profit Corporation Law, owns and operates a Fitness Center (the “Fitness Center”) on the Club’s property at 4475 North Ocean Blvd., Delray Beach, Florida for the enjoyment of the Club’s members, their immediate family (including children, grandchildren, and parents) and other guests. In consideration of, and as a condition to, the use of the Fitness Center by the undersigned member of the Club (the “Member”), the Member’s immediate family and other guests, and any individual retained to provide physical training and/or rehabilitation services to any of the foregoing (each such individual being a “Facility User” and, collectively, all such individuals being the “Facility Users”), the Member has executed and delivered to the Club this Fitness Center Assumption of Risk, General Release, Indemnification, and Covenant not to Sue Agreement (this “Agreement”) in which the Member acknowledges and agrees
