By this EZPAYnow Electronic ACH Funds Transfer Agreement (“Agreement”), between Secure Payment Systems, Inc. (“SPS”) and the undersigned (“Subscriber”), the parties mutually agree that this Agreement is effective on the later of , 2021 or the effective date of this Agreement and applies to those transactions transmitted by Subscriber to SPS for the initiation of ACH debits and credits to consumer and business demand deposit accounts resulting from legitimate business transactions properly authorized by the party to be debited or credited and conducted in compliance with all local, state, federal, and Uniform Commercial Code statutes.
