EBS EXCESS CAPACITY USE AND ROYALTY AGREEMENTEbs Excess Capacity Use and Royalty Agreement • January 7th, 2005 • North Carolina
(“Agreement”), is entered into this day of January, 2005, by and between Guilford County Schools, with its principal offices 712 N. Eugene Street, Greensboro, NC 27401 (“Licensee”), and Fixed Wireless Holdings, LLC, a Delaware limited liability company with its principal offices at 5808 Lake Washington Blvd., N.E., Suite 300, Kirkland, WA 98033, together with its affiliates (“Operator”). Licensee and Operator shall be referred to collectively herein as the “parties,” and individually as a “party.” This Agreement shall be binding upon the parties as of the date of this agreement with respect to those rights, duties and responsibilities that can be performed by the parties prior to any required FCC consent and prior to the effectiveness of the new Part 27 rules for EBS and BRS.
