This Purchase Order is issued pursuant to the current governing Master Environmental Services Agreement (MESA) between the Owner on the Purchase Order and the architect/consultant to whom this Purchase Order is addressed (“Architect/Consultant”). Any capitalized terms not defined herein shall have the meanings given them by the MESA. By accepting this Purchase Order and performing the services described herein, Architect/Consultant agrees that such services will be performed for the benefit of Albertsons Companies and all its subsidiaries having an interest in the Project Site (the “Benefited Albertsons Companies and its Entity(ies)”) and will be governed by the MESA, which is hereby incorporated by reference. For purposes of this Purchase Order, all references to Albertsons Companies and all its subsidiaries in the MESA will be deemed to refer to Albertsons Companies and all its subsidiaries and the Benefited Albertsons Companies and its Entity(ies).
