The staff has reviewed the proposed Trust Agreement submitted in your July 24, 2003 letter. To expedite issuance of a Trust Agreement acceptable to the NRC, the staff revised your July 24 submittal consistent with the NRC’s Regulatory Guidance, NUREG-1727, “Consolidated NMSS Decommissioning Guidance.” The revised trust agreement retains Fansteel’s objective of limited withdrawals from the trust, provides additional explanation of the replenishment provision Fansteel proposed, and specifies certain attestations required to make withdrawals, among other items.
