Between the parties The Upper Lachlan Shire CouncilABN 81 011 241 552 of 44 Spring Street, Crookwell NSW2583(Council) Newtricity Developments Biala Pty Ltd ABN 93 605 533 935(Company) Recitals 1 The Council has agreed to establish a Community Enhancement Fund.2 The Company has agreed to pay to the Council's Community Enhancement Fund Monetary Contributions to fund community projects primarily in the area surrounding the Biala Wind Farm.3 The Council agrees to be the custodian of the Monetary Contributions paid by the Company to the Community Enhancement Fund and to distribute and expend the funds in the Community Enhancement Fund in accordance with this deed.The Company has lodged the Biala Development Application.
