This PERFORMANCE AGREEMENT (the "Agreement") made and entered this ____ day of August, 2014, by and between the CITY OF HAMPTON, VIRGINIA (the “Locality”), a municipal corporation of the Commonwealth of Virginia, the ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF HAMPTON, VIRGINIA (the “Authority”), a political subdivision of the Commonwealth of Virginia, FORT MONROE AUTHORITY (“FMA”), a political subdivision of the Commonwealth of Virginia, and Liberty Source PBC, a Delaware public benefit corporation authorized to transact business in the Commonwealth of Virginia as Liberty Source PBC Corp. (the Company”), (collectively, “the Parties”).
