Plaintiffs Julio Lopez and Michael Oros (collectively referred to as “Plaintiffs” or “Class Representatives”), on behalf of themselves and all others similarly situated, and Defendant Volusion, LLC (“Volusion” or “Defendant”) (collectively, the “Parties”), by and through their respective counsel, hereby enter into this Class Action Settlement Agreement and Release (“Settlement Agreement”), subject to Court approval. In consideration of the mutual promises, agreements, and covenants contained herein, the sufficiency and receipt of which are hereby acknowledged, the Parties stipulate and agree as follows:
