Aboriginal Intangible Heritage Agreement for the purposes of the Aboriginal Heritage Act 2006 Foreword This approved form is to be used by parties negotiating an Aboriginal intangible heritage agreement (AIHA) under Part 5A of the Aboriginal Heritage Act 2006 (“the Act”). Pursuant to s. 79D(1) of the Act, at least one of the parties to an Aboriginal intangible heritage agreement must be a registered Aboriginal party (RAP), a registered native title holder (RNTH), or a traditional owner group entity (TOGE). Any other person or body may also be a party to the agreement. Given the broad possible content of, and range of parties to, an AIHA, parties will need to adapt this form for their purposes. Except where otherwise indicated, clauses contained within the agreement are generally applicable to any type AIHA. Clauses highlighted in blue are optional, depending on who the parties to the agreement are and what the content of the agreement is. Locations where information is required
