THIS FUNDING LOAN AGREEMENT, dated as of January 1, 2015 (the “Funding Loan Agreement”), is by and among MUFG UNION BANK, N.A., in its capacity as the funding lender hereunder (together with any successor to its rights, duties and obligations hereunder, the “Bank”), HOUSING AUTHORITY OF THE CITY OF SAN DIEGO (the “Issuer”), a public body, corporate and politic, organized and existing under the laws of the State of California (together with any successor to its rights, duties and obligations hereunder, the “Governmental Lender”) and MUFG UNION BANK, N.A., in its capacity as the fiscal agent hereunder (together with any successor to its rights, duties and obligations hereunder, the “Fiscal Agent”).
