This First Amendment to Development Agreement (“First Amendment”) is entered into this day of , 2018, by and between the City of Tempe, an Arizona municipal corporation (“City”), Seventh Street Tempe AZ Owner, LLC, a Delaware limited liability company (“SSTAZ”) and 7th and University Tempe Owner, LLC, a Delaware limited liability company (“7UT” and together with SSTAZ, the “Developer”). The City and Developer are sometimes referred to as the “Parties” and individually as a “Party.”
