The Company and Licensee agree that the following terms and conditions will apply to any Licensee order to license use of the Company’s software, in machine readable (object code) form as described more fully in Exhibit A attached hereto (the “Company Software”). The Company Software and related documentation and supporting materials provided by the Company from time to time in either machine readable or hard copy form (the “Documentation”) are referred to collectively in this Agreement as the “Licensed Materials.” In consideration of the mutual promises contained in this Agreement, the parties agree as follows:
