This Class Action Settlement Agreement (“Agreement”), effective upon the date of the signatories below, is made by and between, on the one hand, Mondelez Global LLC, on behalf of nominal defendant Mondelez International Inc. (“MDLZ”), and on the other hand, the Class Representatives (defined below) on behalf of the Class (defined below) (collectively, the “Parties”), in the matter of McMorrow et al. v.
