, 2009 (“Effective Date”) is made and entered into by and between Westervelt Renewable Energy, LLC, a limited liability company organized and existing under the laws of the State of Delaware and having its principal place of business at 1400 Jack Warner Pkwy NE, Tuscaloosa, Alabama 35404 (hereinafter referred to as “Generator”), and Alabama Power Company, a corporation organized and existing under the laws of the State of Alabama and having its principal place of business at 600 18th Street North, Birmingham, Alabama 35203 (hereinafter referred to as “Alabama Power”). Generator and Alabama Power may be hereinafter referred to individually as a “Party” and collectively as the “Parties.”
