PREAMBLE: This Funding Agreement (Agreement) between Virginia Electric and Power Company d/b/a Dominion Energy Virginia, a Public Service Corporation incorporated in the Commonwealth of Virginia (Dominion) and the Norfolk District of the U.S. Army Corps of Engineers (USACE) (collectively "the Parties") sets forth the responsibilities of the Parties regarding the expedited review of permit applications, both project- and program- related, for utility projects. The purpose of this Agreement is to achieve timely design and implementation of utility projects within the Commonwealth of Virginia while also assuring such design and implementation is sensitive to the protection of Waters of the United States, as that term is referred to in the Clean Water Act and its implementing regulations, and assuring such design and implementation is in accordance with federal statutes the USACE administers.
