Each Party shall be responsible for the action of each Party’s own employees, officials, officers, and agents. The Parties expressly agree that nothing in this Agreement shall be construed as a waiver by the Parties of any rights, privileges, defense, remedies or immunities available to the Parties as governmental entities.
