AGREEMENT FOR DEPOSIT OF FUNDS TO SECURE MAINTENANCE OF PUBLIC IMPROVEMENTS

This agreement is made by and between the City of La Center, a Washington municipal corporation, (“City”) and D.R. Horton-Portland Inc., an Delaware corporation, (“Horton”) and will be effective on the later of (i) the date that it is fully executed, and (ii) the date on which Horton acquires approximately fifty (50) lots within the future plat of Riverside Estates Subdivision Phase 2 (the “Property”). In the event that Horton has not acquired the Property on or before April 27, 2023, then this agreement shall be void and of no further force and effect.
