Premier of the State of Western Australia, acting for and on behalf of the said State and its instrumentalities from time to time (hereinafter called “the State”) of the one part and BHP MINERALS PTY. LTD. ACN 008 694 782 a company incorporated in the State of Western Australia and having its registered office at Level 18, 200 St. George’s Terrace, Perth, BHP ENERGY HOLDINGS PTY. LTD. ACN 058 025 960 a company incorporated in the State of Western Australia and having its registered office at Level 18, 200 St. George’s Terrace, Perth, and BHP POWER HOLDINGS PTY. LTD. ACN 058 169 743 a company incorporated in the State of Western Australia and having its registered office at Level 18, 200 St. George’s Terrace, Perth, (hereinafter collectively called “the Joint Venturers” in which term shall be included their respective successors and permitted assigns) of the other part.
