You sponsor and maintain a retirement plan (“Plan”), which may or may not be qualified under section 401(a), 403(b), or 457(b) of the Internal Revenue Code of 1986 (“Code”), and/or subject to the Employee Retirement Income Security Act of 1974 (“ERISA”). The term “you” as used in this Agreement refers to the Plan sponsor, trustee or other authorized officer of the Plan that is identified on and that signs on behalf of the Plan in the Account Application Employer-Sponsored Retirement Plan – Direct Business (“Account Application”).
