Economic growth based on innovation and trade agreements facilitate transfer of technology between countries. The World Trade Organization (WTO) enables members to enter into regional trade agreement granting more favorable trade conditions to its fellow signatories than it does to other parties and provide the legal basis for preferential trade agreements between developing countries. To exploit these regional trade opportunities, the African Union (AU) undertook to establish the African Continental Free Trade Area Agreement (AfCFTA) and to bring coherence to the regional intellectual property (IP) cooperation. The inclusion of IP in trade agreements provide an opportunity to set common rules on IP protection and a common approach to the use of flexibilities offered through WTO’s Trade-Related Aspects of Intellectual Property Rights (TRIPS) Agreement.
