This APEX Distributor Agreement (the “Agreement”) applies to the Dell Technologies “APEX” branded service (“APEX Service”) ordered on the Dell Technologies APEX Console (“APEX Console”) by you on behalf of your company, (“Purchaser”, “You”) from the Dell Technologies entity which invoices Purchaser for the APEX Service (“Dell”). By clicking “I agree” or otherwise accepting the Agreement in the APEX Console: Purchaser agrees to be legally bound by the Agreement; and you represent to Dell that you are authorized to agree to the Agreement on behalf of Purchaser. The “Effective Date” of the Agreement is the earlier of the date Purchaser accepted the Agreement or the date Customer first used the APEX Service.
