This National Settlement Agreement is entered into by and among the Representative Plaintiff Moshe Chetrit, on behalf of himself and the Settlement Class Members, and Defendant Société en commandite Touram, d.b.a. Air Canada Vacations (“Touram”), and resolves in full the Action. Subject to Court approval as required by the Code of Civil Procedure, CQLR, c. C-25.01, and as provided herein, the Parties hereby stipulate and agree that, in consideration for the promises and covenants set forth in the Agreement and upon the issuance by the Court of a Final Judgment Approving Settlement and the occurrence of the Effective Date, the Action shall be settled and terminated upon the terms and conditions contained herein.
