Trust Agreement (as previously amended and restated effective November 1, 2005, the “2005 Trust Agreement”) and as subsequently amended effective as of December 31, 2013, hereby amends and restates the 2005 Trust Agreement effective as of May 1, 2017 (“Effective Date”). The 2005 Trust Agreement, as amended and restated, is hereby renamed as the “ClearPoint Cemetery Merchandise and/or Services Master Trust Agreement” (“Trust Agreement”) and will continue to be binding upon those persons or entities who previously executed a commitment to be bound by the terms and conditions of the 2005 Trust Agreement as “Trustor” (such persons or entities being hereinafter referred to individually as “Trustor” and referred to collectively as “Trustors”).
