These terms and conditions for Cloud-Based Services (the “Agreement”) are between Arcserve (USA) LLC including its affiliates (“Arcserve” “we,” “us,” or “our”), and You the person or entity enrolling in the Services, on its own behalf or for the purpose of offering the Services to a third party as part of a managed service being provided thereby (“you,” “your,” or “Customer”).
