This Trust Agreement (“Trust Agreement”) is made this by and between Capitol Area Development Authority (“CADA”), and 1717 S Street Investors, LP ("1717 S Street Investors") (collectively “Settling Parties”), as Trustor, CADA, as Trustee, and the California Regional Water Quality Control Board, Central Valley Region (“Central Valley Water Board”). This Trust Agreement is part of an “Agreement and Covenant Not To Sue” entered into by and between the Settling Parties and the Central Valley Water Board.
