This Agreement, including Amendment No. 1 (TRO Amendment) hereto (“Agreement”) shall be deemed effective as of December 20, 2004 (the “Effective Date”), between Digital Network Access Communications Inc. (“DNA”), a corporation organized under the laws of the State of Illinois, with offices at 601 First Avenue, Rochelle, IL 61068 and Verizon North Inc. and Verizon South Inc. (“Verizon”), a corporation organized under the laws of the State of Wisconsin with offices at 8001 West Jefferson, Ft. Wayne, IN 46804 (Verizon and DNA may be referred to hereinafter, each, individually as a “Party”, and, collectively, as the “Parties”).
