The Texas Facilities Commission (hereinafter referred to as “TFC”), a state agency located at 1711 San Jacinto Boulevard, Austin, Texas 78701, as Owner (as defined in 2015 Uniform General Conditions, Section 1.28) and Cobb Fendley & Associates, Inc. (hereinafter referred to as “SSE”), located at 505 East Huntland Drive, Suite 100, Austin, Texas 78752, enter into the following agreement for professional architectural and engineering services (hereinafter referred to as the “Agreement”) pursuant to the Professional Services Procurement Act, Tex. Gov’t Code Ann. Ch. 2254, Subchapter. A, to be effective as of the Effective Date (as defined below). The project for which SSE agrees to provide professional engineering is generally described as Pre- Construction and Pre-Design Site Services Engineering Services for the North Austin Complex Phase II (hereinafter collectively referred to as the “Project”).
