A Californian sublease agreement is a document between a current tenant (under-less) and subtenant (under-lessee) for the use of residential space already rented through a lease. Before entering into a contract with the sub-lessee, the sub-lessor will need to obtain permission or consent written by their landlord to submit ownership to the terms of active leasing. The terms concerning the original lease agreement and a new form sublease agreement may vary depending on the rights it grants to the sub-lessee, and the laws governing the State of California and the local jurisdiction of the property may determine the rights of the subtenant. A sublease agreement cannot exceed the length of the lease between the tenant and the owner.
