Memorandum of Understanding Between the National Treasury Employees Union and the Internal Revenue Service

The Internal Revenue Service (IRS, Agency, or Employer) and the National Treasury Employees Union (NTEU or Union) (collectively, the parties) hereby enter into this Memorandum of Understanding (MOU) regarding the implementation of Paid Parental Leave (PPL). On December 20, 2019, the National Defense Authorization Act of FY 2020 (NDAA) was passed. As part of the NDAA, PPL was signed into law thereby providing twelve (12) administrative workweeks (up to 480 hours) to all federal employees (regardless of gender) who meet qualifying criteria, for birth, adoption, or foster care placements occurring October 1, 2020, or later. Because PPL is substituted for unpaid leave under the Family Medical Leave Act (FMLA), the use of FMLA leave for purposes other than the birth or placement of a child (e.g., leave based on a serious health condition) during a 12-month FMLA period may reduce the FMLA leave available for birth or placement purposes
