THIS SOLAR LEASE AND EASEMENT AGREEMENT (this “Agreement”) is made, dated and effective as of , 2022 (the “Effective Date”), by and between H-KO Farms, LLC, together with its successors, assigns and heirs, comprising “Owner”), and Butler Public Power District, a political subdivision of the State of Nebraska (together with its transferees, successors and assigns, “Tenant ”), and in connection herewith, Owner and Tenant agree, covenant and contract as set forth in this Agreement. Owner and Tenant are sometimes referred to in this Agreement as a “Party” or collectively as the “Parties”. Today’s Power, Inc. a corporation organized under Arkansas law shall be the Tenant ’s Third-Party Beneficiary, (“3rd Party Beneficiary”), which shall assume certain rights, responsibilities, and liabilities set forth in all Sections below.
