Question QUT Response Pre-approval requirements The Agreement refers to continuous shift workers and offers them an additional week of annual leave, however the Agreement does not describe or define an employee as a shift worker for the purpose of the National Employment Standards (NES) as required by section 196 of the Fair Work Act 2009 (Act). To satisfy the Deputy President of her concern, you may wish to provide anundertaking to the effect that, for the purpose of the additional week of leave, a shift worker is defined as for the purposes of the NES. QUT does not currently employ any continuous shift workers. However, QUT proposes theattached undertaking to address the Deputy President's concerns. Mandatory Terms The consultation term located at clause 11 of the Agreement does not allow for representation as required by s 205(1) and (1A) of the Act.
