THIS CONFIDENTIALITY & NON-DISCLOSURE AGREEMENT (hereinafter “Agreement”) is hereby executed between the State of New York (hereinafter “State”), acting by and through the New York State Office of Information Technology Services (hereinafter “ITS:), having its principal place of business at State Capitol, ESP, P.O.
