THIS SITE LEASE (as amended, amended and restated, supplemented or otherwise modified from time to time, the “Site Lease”) is made and entered into as of , [2021], by and between the SAN DIEGO UNIFIED PORT DISTRICT, a public corporation (the “Port”), as lessor, and the CHULA VISTA BAYFRONT FACILITIES FINANCING AUTHORITY, a California joint exercise of powers authority (the “JEPA”) established and existing pursuant to an Amended and Restated Joint Exercise of Powers Agreement, dated and effective as of July 25, 2019 (as amended, amended and restated, supplemented or otherwise modified from time to time, the “JEPA Agreement”) by and between the City of Chula Vista, a California charter city (the “City”) and the Port, as lessee.
