This Amended and Restated Settlement Agreement and Release (“Agreement”) is made and entered into this 2nd day of July, 2013, by and among (1) Plaintiffs, for themselves and on behalf of the Settlement Class, and (2) U.S. Bank National Association (“U.S. Bank”), subject to preliminary and final approval as required by Rule 23 of the Federal Rules of Civil Procedure. As provided herein, U.S. Bank, Settlement Class Counsel and Plaintiffs hereby stipulate and agree that, in consideration of the promises and covenants set forth in this Agreement and upon entry by the Court of a Final Order and Judgment, all claims of the Settlement Class against U.S. Bank in the actions titled In Re: Checking Account Overdraft Litigation, Case No. 1:09-md- 02036-JLK; Speers v. U.S. Bank N.A., Case No. 09-23126-JLK; Waters et al. v. U.S. Bancorp, N.A., Case No. 09-cv-2071-JSW; and Brown v. U.S. Bank, N.A., Case No. CV-10-356-RMP
